Trade-marks may be, but do not have to be, registered at the Trade-marks Office. Registration gives the owner of a trade-mark the exclusive right to use the trade-mark across Canada and creates a presumption that the owner does, in fact, own the trade-mark.

A trade-mark is pending registration if an application to register at the Trade-marks Office has been made and is currently being assessed. If an application to register is successful, the Trade-marks Office will issue a Certificate of Registration and enter the registration on its records.
